What information do we collect, and how do we collect it?

We may collect several types of information from and about users of our Sites, which may consist of information by which you may be personally identified (including your name, postal address, e-mail address, telephone/mobile number, billing information or any other information the Sites collect that is defined as personal or personally identifiable information under an applicable law) (collectively, “Personal Information”); information that is about you but does not identify you, such as your dining history/habits, reservation data and site activity/behavior; and/or information about your internet connection, the equipment you use to access the Sites and usage details.

If you submit someone else’s personal information to us, you represent that you are authorized to provide this information to us.

YOUR SEARCH QUERIES ON THE SITES.

As with many other websites, the web servers used to operate the Sites may automatically collect certain data pertaining to you, including your location, computer operating system, Internet Protocol (IP) address, access times, browser type and language, and the website you visited before or after visiting our Sites. SMS Terms and Conditions

Please read these terms and conditions carefully. We may periodically offer you the opportunity to sign up to receive SMS text messages from us. By clicking the box or advertisement to sign up for one or more text messaging programs, you expressly consent to receive non-marketing and marketing text messages from us and others texting on our behalf, including text messages made with a third-party IP service at the telephone number(s) that you provide.  You may opt-out of these communications at any time, and consent to receive marketing text messages is not required to Use the Sites. We may use a 3rd party IP service to deliver text messages to you which are intended to provide you with information about us, our services, products and the Sites, events, recipes, coupons, promotions, product launches, sweepstakes, and contests and other items which we feel may be of interest to you based on your use of the Sites.

Cost

Message and data rates may apply to each text message sent or received from us, as provided in your mobile telephone service rate plan (please contact your mobile telephone carrier for pricing plans), in addition to any applicable roaming charges.  We do not impose any separate fees for sending or receiving text messages.

How to Opt-In

To opt-in to receive text messages from a Wow Bao text messaging program(s), please follow the instructions provided by the specific advertising or offer from which you wish to receive messages. We will clearly describe what you are signing up for and how frequently you can expect text messages related to the campaign you sign up for when you elect to opt-in

How to Opt-Out

When you sign up to receive text messages from us, you will receive a welcome message. To stop receiving text messages from a specific text messaging program, follow the prompts in the welcome message for the text messaging program from which you no longer wish to receive message (i.e., the ten digit number from which its text messages are being sent).  You will then receive confirmation of your opt-out of that text messaging program.  This will only opt you out of the specific text messaging program associated with that ten digit number.  You will remain opted in to other Wow Bao text messaging programs, if applicable.

Your Mobile Telephone Number

You represent that you are the account holder for the mobile telephone number(s) that you provide. You agree to indemnify us and our affiliates in full for all claims, expenses, and damages related to or caused in whole or in part if you provide us with an inaccurate number or by your failure to notify us if you change your telephone number, including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act and other applicable laws.

Access or Delivery to Mobile Network is Not Guaranteed

Delivery of information and content to a mobile device may fail due to a variety of circumstances or conditions.  You understand and acknowledge that network services, including but not limited to mobile network services, are outside of Wow Bao’s control, and we are not responsible or liable for issues arising from them.

To request more information, text “HELP” to the ten digit number for the text messaging program about which you have questions (i.e., the ten digit number from which its text messages are being sent).

Eligibility

To receive text messages from us, you must be a resident of the United States and 18 years of age or older.  We reserve the right to require you to prove that you are at least 18 years of age. By signing up for text message notifications, you represent that you are 18 years of age or older.

Termination of Text Messaging

We may suspend or terminate your receipt of text messages from us if we believe you are in breach of our Privacy Policy or Terms and Conditions.  Your receipt of Wow Bao text messages is also subject to termination in the event that your mobile telephone service terminates or lapses.  We reserve the right to modify or discontinue, temporarily or permanently, all or any part of a text message campaign with or without notice.

Communications and Consent to Electronic Notices

You may communicate with Wow Bao via postal mail, e-mail, telephone, and/or our Sites. We may issue notices via these various channels, including by sending e-mail to an address you provide.  You agree that such notices shall have legal effect.  You also agree that notices sent by e-mail satisfy any requirement that notices be provided in writing.  You may have the right to withdraw your consent to receive certain electronic communications, and, when required by law, we will provide you with paper copies upon request.  You may make such a request via by contacting us using the contact information provided in this Privacy Policy and our Terms and Conditions.  To receive, access, and retain the notices that we may send via e-mail, you must have Internet access and a computer or device with a compatible web browser.  You will also need software capable of viewing files in PDF format.  Your device or computer must have the ability to print, or download and store, e-mails and PDF files.  By accepting these terms, you confirm that you are able to receive, access, and retain the notices that we may send.

How will we use the information you provide to us?

We may share your information with our Contractors and affiliates (including our affiliated restaurant companies) in order to provide services to you and for other lawful business reasons. We may sell, transfer, or otherwise share some or all of our assets, including your Personal and non-Personal Information and data we have collected from you consistent with this Privacy Policy and our Terms and Conditions, in connection with a merger, acquisition, reorganization, or sale of assets, or in the event of bankruptcy.  By using the Sites and providing us with your information, you expressly agree that we may do so.

We may decide from time to time to utilize third-party business and marketing partners in delivering the content, materials and services available on or through the Sites to you. We may share your information with these business and marketing partners for any lawful purpose, including to communicate with you or to fulfill your requests for our services, and to further our mission as an organization. To use certain services on our Sites, such as to purchase gift cards or other products or services, or place an order, we may require credit or debit card account information. What choices do you have?

You are under no obligation to provide us with personally identifiable information, but without it we may not be able to provide you the products or services you request. If you do opt out, we may still send you non-promotional emails, such as emails about ongoing business relations. Wow Bao does not itself store your credit or debit card account information, and we do not have direct control over or responsibility for your credit or debit card account information. Our contracts with third parties that receive your credit or debit card account information require them to keep it secure and confidential. If you become aware of any breach of Site security, this Privacy Policy, or the Terms of Use, please notify us immediately.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Location of the Site

This Site are hosted and operated in the United States. However, we and our Contractors may, in our effort to provide the Site, store collected information in the United States, or we may transfer it to, and store it within, other countries.

Those who access or use the Site from jurisdictions outside the United States do so at their own choice and risk and are solely responsible for compliance with local law.
